Kamara, Korte Suprema, hahadlang kaya sa batas militar ni Gloria?

“We have learned the bitter lessons of Martial Law even as we are acutely aware of the propensity for abuse by the current regime. As we continue to demand justice for the victims of the Ampatuan massacre, we call on the public to remain vigilant at this time against possible abuses on civilians that may stem from this declaration,” sabi ng Bagong Alyansang Makabayan (Bayan).

Sinabi pa ng Bayan na hindi mapagkakatiwalaan ang militar at pulis na sugpuin ang mga salarin sa masaker sa ilalim ng batas militar dahil sangkot mismo ito sa masaker. “The recently discovered arms cache in the Ampatuan residence shows the complicity of the AFP, PNP and the regime in supplying weapons to the local warlords. With this kind of track record, how do you trust the AFP and PNP with the vast powers of Martial rule? This kind of corruption and complicity cannot be solved by the declaration of Martial rule,” ayon pa sa Bayan.

Bakit magdedeklara?

Para sa mga militante, posibleng sinusubok lamang ng gobyernong Arroyo ang deklarasyon ng batas militar sa Maguindanao, Sultan Kudarat at Cotabato City. Kung matagumpay nilang madedeklara ito, maaaring opisyon din ang batas militar sa buong bansa. Ang layunin: ipreserba ang kapangyarihan ni Pang. Arroyo.

Sa pamamagitan umano ng deklarasyong batas militar sa buong bansa, makakapanatili si Arroyo sa puwesto lampas sa 2010, habang mapupuksa niya ang mga puwersang tumututol sa kanya gamit ang militar. Maiiwasan din umano niya na mahabla sa mga kaso ng paglabag sa karapatang pantao, korupsiyon at pandaraya sa halalan.

“As the president’s term and immunity from suit shall expire at noon of June 30, 2010 and plunder and human rights abuses cases shall certainly be immediately filed against her, it is not impossible for her to think about placing the entire country under martial law to perpetuate herself in power and avoid punishment for her crimes,” sabi pa ng NUPL.

Isa pang posibleng dahilan ng deklarasyon, ayon sa mga militante at palagay rin ni Sen. Aquilino Pimentel Jr., ay ang pagtago diumano ng gobyernong Arroyo sa mga ebidensiya na maaaring magdiin kay Arroyo sa pandaraya sa halalang pampanguluhan noong 2004. Matatandaang noong nireyd ng militar ang mansiyon ng mga Ampatuan noong Huwebes, nabalitang nakatagpo ang militar ng mga paraphernalia at ballot boxes sa halalan, maliban sa mga bala at baril na nakarehistro sa PNP at Department of National Defense.

“The Ampatuans have threatened that if the government would nail them down, they would reveal what really happened in the past two elections,” sabi ni Pimentel.

Hiniling ni Pimentel sa mga opisyal ng Commission on Elections na imbestigahan at kunin ang nakuhang mga dokumentong panghalalan sa mansiyon ng mga Ampatuan. Minungkahi pa niyang agarang papuntahin sa Maguindanao ang pinuno ng legal department ng Comelec na si Atty. Fernando Rafanan.

Ngunit lahat ng ito, mahirap gawin kung nasa ilalim na ng batas militar ang Maguindanao. “[D]ue to martial law, the public may not be able to know what is happening. The people are afraid to speak.  Even journalists may not be able to report the truth because of threat to their lives. Warrantless arrest are being enforced and they can be picked up on order of martial law authorities,” sabi ni PImentel.

Kasabay ng paghiling sa Kamara na ibasura ang Proclamation 1959, hihilingin naman ng NUPL sa Korte Suprema na ideklarang ilegal ito.

Tila ito na ang huling dalawang baraha na ng mga militante at ng buong oposisyon ang pagdulo. Kapag natalo pa rin dito dahil kontrolado na ng Malakanyang ang Kamara at Korte Suprema, malamang na sa kalsada na lamang ang tanging labanan.
